 Illegal Alcohol Stings in Mobile? |

Mardi Gras is here, and so is the beer! Thousands will be purchasing and consuming alcoholic beverages by the gallons this festival season. Unfortunately enough, some of those people making beer purchases will be underage - and some of those underage persons are either police officers, police cadets, or volunteers who have agreed to work with the police in an effort to catch merchants selling beer to minors.
Here's how it works (the short version). A police officer sets up a camera to record transactions made by the merchant. He then sends an underage person to that merchant in an attempt to purchase an alcoholic beverage. If the merchant asks the purchaser for ID, he is required to show his ID, at which time the sale should be refused. If the merchant does not ask for ID, and he sells the alcoholic beverage to the purchaser, the merchant is later approached by a police officer who either writes a citation, or arrests the violating merchant.
Stings like this have been going on for years in Mobile, regardless of whether-or-not festival season is underway. The City of Mobile is so proud of its sting operations that it even publishes the names of those people caught in their stings in the local newspaper. Unfortunately for the City of Mobile, these sting operations will one day land the City of Mobile in a legal action (possibly a lawsuit), considering the fact that sting operations such as these are considered illegal according to the opinion of the United States Attorney General.
That's right! The U.S. Attorney General has determined that the civil rights of the people are violated by law enforcement officers in alcohol stings such as the one described above, and people across the nation are finally standing up and fighting back in the courts.
The U.S. Attorney General's guidelines are based on U.S. Supreme Court decisions and exist in order to protect the rights of the innocent while convicting the guilty. Those guidelines insist, for example, that sting operations can only be conducted against the "unwary guilty", not the "unwary innocent".
To prevent illegal entrapment retail establishments should not be randomly selected for sting operations. That would not prevent entrapping a clerk who sells "innocently due to a momentary lapse in judgement" as a result of being rushed, from being distracted, or any other reasonable cause.
"The only way to ensure that only the "unwary guilty" are caught in the trap is to create a history of the cashier in question with the use of surveillance or repeated compliance checks which are not also sting operations." Since many, if not most of those caught in these sting operations have passed previous compliance checks, which clearly proves that they have no criminal predisposition to make underage sales, they have already demonstrated their lack of such a criminal tendency.
Unfortunately, many law enforcement agencies fail to protect the rights of innocent citizens and illegally entrap them in underage alcohol sales stings. This form of illegal entrapment is an attempt to induce law-abiding citizens into engaging in crimes that they would not otherwise have committed. It tricks and deceives the innocent into breaking the law and is a federal offense. In the words of the U.S. Supreme Court, entrapment "deserves the severest condemnation".
Now, a look at the law enforcement operatives participating in the illegal sting.
One or more law enforcement officers becomes guilty of solicitation to commit a crime when he commands, encourages or requests another person to engage in specific conduct which would constitute such crime or an attempt to commit such crime or which would establish his complicity in its commission or attempted commission (http://definitions.uslegal.com/c/criminal-solicitation/). He is made guilty by the fact that he has an underage person purchase or attempt to purchase alcoholic beverages. After all, it is illegal for an underge person (anyone under the age of 21 in the State of Alabama) to either purchase or to be in possession of alcoholic beverages. And that brings us to the person attempting to make the purchase. That person is underage (under the age of 21), so his act of attempting to make the purchase of alcohol is, in itself, illegal. When he is successful, and he takes possession of the alcoholic beverage, he has then entered further into his illegal activities. Now, I'm not an attorney, but I do know how to read, and the law is available in print for the entire world to read. Nowhere in the law have I found it written that law enforcement officers are exempt from abiding by the very laws that they are sworn to uphold and defend. They are people, just like you and me, and they are bound to abide by the very same laws that you and I are bound to abide by.
So, if you are a merchant caught in an alcohol sales sting, my recommendation to you (other than to say "get your act together") is to hire yourself an attorney and sue the crap out of the government agency that entrapped you. The law is on your side if you are considered to be one of the many "unwary innocent" people caught in these types of stings. It is only by standing up for your rights that we will be able to put a stop to this form of abusive police action within our city.
